SalesQL Affiliate Program Terms

These Affiliate Program Terms (the "Affiliate Terms") set out the rules for participating in the SalesQL Affiliate Program (the "Program") operated by SALESQL LTD, a private limited company registered in England and Wales under company number 11982774 ("SalesQL", "we", "us" or "our").

By submitting an application to the Program, by accepting these Affiliate Terms at sign-up, or by promoting SalesQL through a SalesQL referral link, you ("you" or the "Affiliate") agree to these Affiliate Terms. If you do not agree, do not join the Program and do not promote SalesQL as an affiliate.

These Affiliate Terms supplement the Terms of Service, the Acceptable Use Policy and the Privacy Policy. Capitalised terms not defined here have the meanings given in those documents. Where these Affiliate Terms conflict with those documents in relation to Program participation, these Affiliate Terms control.

#1. Eligibility and acceptance

You must be at least 18 years old and able to enter into a binding contract to join the Program. Your participation is solely to lawfully promote SalesQL and, in return, to receive a commission on qualifying purchases made by users you refer through your unique referral link.

Applications are reviewed before approval. We may approve or reject any application, at our discretion. You become an authorised Affiliate only once your application is accepted; until then, any promotion you carry out does not qualify for commission. If your status as an Affiliate is later terminated, you stop being an Affiliate, you forfeit any right to further payouts, and you must not re-apply to the Program using the same or any other name, email, or identity.

When you apply, you must give us accurate details about how you intend to promote SalesQL, including the website URL(s), social profiles, and other channels you will use, and a clear description of your promotion methods. We require this information at sign-up and rely on it to assess your application. You must keep it accurate and up to date, and tell us before you start promoting through a materially different channel or method. We review your affiliate profile and promotion activity again before and during payouts; promotion through channels you did not disclose, or that is inconsistent with the profile you gave us, is a breach of these Affiliate Terms and may result in withheld or forfeited commissions.

#2. How the Program works

The Program is operated through our affiliate portal — the affiliate platform we designate from time to time, which may change and may be provided by a third party or operated by SalesQL. To participate you must create and maintain an account on the affiliate portal and provide accurate information. You are responsible for keeping your account credentials confidential and for all activity under your account. Where the affiliate portal is operated by a third party, your use of it is also subject to that provider's own terms and privacy policy.

On approval you receive a unique referral link. When someone clicks your referral link and then makes a qualifying purchase, that purchase is attributed to you and you earn a commission on it, as described below. Referrals are attributed through the cookies and tracking used by the affiliate portal, subject to the user's cookie choices and to the limits of cookie-based attribution.

#3. Commissions

You earn the commission stated on the Program sign-up page and in your affiliate portal dashboard (currently a recurring percentage of qualifying payments from users you refer), subject to these conditions:

  • The qualifying purchase must take place after your acceptance into the Program and be tracked to your referral link through the affiliate portal.
  • Commission is calculated on the net purchase amount, excluding taxes, and only on successfully completed, non-refunded payments.
  • You may not refer yourself, your own accounts, members of your household, or other accounts within your own organisation, and you earn no commission on such referrals.
  • There is a limit of one referral relationship per referred customer.

If a payment on which you were paid commission is later refunded or charged back, we will reverse that commission and may deduct it from your future payouts.

#4. Payouts

Payouts are made through the method configured in the affiliate portal, on the Program's standard payout schedule, for commissions that have cleared and are not subject to reversal. Payouts are subject to a minimum balance of US$100: if your cleared, payable commissions are below US$100 on a payout date, the balance carries over to the next payout cycle until the minimum is reached.

Before your first payout, and again before each subsequent payout, we review your compliance with all conditions of the Program — including the promotion rules in section 5 and the accuracy of your affiliate profile and disclosed promotion channels under section 1. We may withhold or delay a payout while we investigate a suspected breach of these Affiliate Terms or where required conditions are not met, and we may withhold or forfeit commissions earned through any activity that breaches these Affiliate Terms.

#5. Promotion rules

You may promote SalesQL using your referral link on your own website, blog, newsletter, social media, videos, and other content you control, using either the creative we provide or your own materials that are accurate and not misleading. The Program is designed to reward affiliates who create genuine value and bring new audiences to SalesQL.

#5.1 No paid advertising or pay-per-click (PPC)

You must not use any form of paid advertising to promote your referral link or to drive traffic to SalesQL, without our prior written permission. This prohibition is intentionally broad and includes, but is not limited to:

  • paid search advertising on any search engine (including Google Ads, Microsoft/Bing Ads, and similar);
  • display, shopping, discovery, video, or in-stream advertising (including YouTube and the Google Display Network);
  • paid social advertising (including Meta/Facebook, Instagram, LinkedIn, X, TikTok, and similar); and
  • any other pay-per-click, pay-per-impression, pay-per-install, or paid-placement advertising.

This restriction applies whether or not the advertising uses SalesQL brand terms. We have found that affiliate paid advertising — and brand bidding in particular — generally intercepts traffic that would have reached SalesQL anyway and creates no new value, so paid advertising is not permitted by default.

#5.2 No brand bidding or trademark misuse

Even where we grant written permission for paid advertising under section 5.1, you must not, at any time:

  • bid on, or use as keywords, the terms "SalesQL", "salesql.com", "salesql.io", or any variation, misspelling, or term confusingly similar to our name, products, or domains;
  • use our brand terms in ad copy, headlines, display URLs, or landing-page paths in a way that suggests your ad is an official SalesQL ad; or
  • register, use, or bid on domain names, subdomains, or social handles that incorporate or imitate our brand.

If we grant written permission for any paid campaign, you must add all SalesQL brand terms as negative keywords, must keep attribution tracking intact, and must comply with any additional conditions we specify. Removing such restrictions, or running campaigns outside the scope of our permission, is a breach of these Affiliate Terms.

#5.3 No misleading coupon, discount, or deal pages

You must not promote SalesQL through coupon, discount, voucher, or "deal" pages or pop-ups that:

  • advertise coupons, codes, or discounts that do not exist, do not work, or are not authorised by us;
  • use "reveal", "click to unlock", "scratch", or similar mechanics that insert your referral link when a user attempts to obtain a coupon that does not actually exist; or
  • otherwise mislead users into believing they will receive a discount or benefit in order to capture a referral.

#5.4 No incentivised, deceptive, or low-quality traffic

You must not generate referrals through cashback, rewards, or other incentives offered to the end user without our prior written permission; through cookie stuffing, forced clicks, automated traffic, bots, or hidden iframes; through spam (including unsolicited bulk email, messaging, or newsgroup posting); through false or misleading claims about SalesQL, its features, pricing, or performance; or through sites that contain or promote illegal, infringing, adult, or otherwise objectionable content. You must disclose your affiliate relationship wherever required by law, including under applicable advertising and consumer-protection rules (such as US FTC endorsement guidelines).

#5.5 No link cloaking or domain obfuscation

You must not hide, mask, or misrepresent the website, domain, or channel through which your referred users reach SalesQL. In particular, you must not use URL shorteners, redirect chains, link cloaking, framing, or any similar technique that prevents us from identifying the genuine source of a referral. The origin of every referral must remain transparent and verifiable; referrals we cannot trace to a disclosed, legitimate source do not qualify for commission and may be reversed.

#6. Intellectual property and use of our brand

We grant you a limited, non-exclusive, revocable, non-transferable licence to use the SalesQL name and the creative we make available, solely to promote SalesQL under these Affiliate Terms and in accordance with any brand guidance we provide. You acquire no other rights in our trademarks, and all goodwill from your use belongs to us. We may revoke this licence at any time.

#7. Suspension and termination

We may reject, suspend, or terminate your participation in the Program at any time, with or without notice, for any reason, including any actual or suspected breach of these Affiliate Terms. Conduct that will ordinarily lead to suspension or termination includes paid advertising or brand bidding in breach of section 5, misleading coupon or deal promotion, incentivised or deceptive traffic, link cloaking or other obfuscation of the referral source, promotion through undisclosed channels, spam, false claims, trademark misuse, and failure to disclose the affiliate relationship.

If we detect activity that breaches these Affiliate Terms, we may invalidate the referrals and pending payouts associated with that activity and reset the affected commission balance to zero, so that nothing is paid out on it. Where the breach is not an isolated incident but a generalised practice — for example, systematically running PPC or other prohibited paid advertising to drive your referrals — we may treat all of your referrals as tainted, reset your entire pending balance to zero, and suspend or terminate your Affiliate account.

On suspension or termination we may withhold, reverse, or forfeit unpaid or pending commissions associated with the breaching activity, and you must stop using your referral link and our brand. Sections relating to commissions already reversed, intellectual property, disclaimers, liability, and governing law survive termination.

#8. Relationship of the parties

You participate in the Program as an independent contractor. Nothing in these Affiliate Terms creates an employment, agency, partnership, or joint-venture relationship. You have no authority to make any commitment, representation, or warranty on our behalf, and you must not present yourself as SalesQL or as authorised to act for SalesQL.

#9. Disclaimers and liability

The Program is provided "as is". We do not warrant that tracking, attribution, or the Program will be uninterrupted or error-free, and we are not liable for any loss of commission resulting from tracking failures, a referred user's cookie choices, refunds, chargebacks, or factors outside our reasonable control. To the maximum extent permitted by law, our total liability arising out of or relating to the Program is limited to the total commissions paid or payable to you in the three months before the event giving rise to the claim.

#10. Changes to these terms

We may change these Affiliate Terms at any time by posting a revised version at the link above. Changes take effect on the effective date stated, or when posted if no date is stated. It is your responsibility to review these Affiliate Terms periodically. Continuing to participate in the Program after a change takes effect constitutes your acceptance of the change; if a change is unacceptable to you, your only remedy is to stop participating and close your Affiliate account.

#11. Governing law

These Affiliate Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to them, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
